1. Agreement and eligibility
These Terms form a contract between you and Colver.im. They apply when you create an account, build or use an agent, buy a subscription, or access an agent shared through Colver.
You must be at least 18 years old and able to enter into this contract. If you use Colver for an organisation, you confirm that you may bind that organisation. Business customers may also enter into a separate written agreement or Data Processing Addendum; that agreement controls if it expressly conflicts with these Terms.
2. Your account
Authentication is handled by Colver's identity service. Keep access to your account and connected services secure, provide accurate onboarding and billing information, and tell us promptly if you suspect unauthorised use.
Usernames are public where shown with a shared agent. Other profile fields are used to operate and adapt the service as described in the Privacy Policy.
3. What Colver provides
Colver helps you define a job and build an agent from instructions, memory rules, tools, checks, files, connectors, and delivery channels. You can test the agent, edit its saved definition, and, where enabled, publish access to authenticated users.
The service is evolving. Features, models, limits, and providers may change. We will not materially reduce a paid service during its current billing period without a valid operational, legal, or security reason.
4. AI systems and review
You are interacting with an AI system when Colver or a created agent responds. AI output may be inaccurate, incomplete, or unsuitable. Similar inputs can produce different outputs, and outputs may not be unique.
You decide whether to use an output or approve an action. Review results, permissions, recipients, and source material before any consequential action. Colver is not a substitute for legal, medical, financial, employment, or other qualified professional advice.
5. Your content
You keep the rights you have in prompts, files, agent definitions, connector data, and other content you provide. You grant Colver a limited, non-exclusive licence to host, process, reproduce, and transmit that content only as needed to provide, secure, support, and improve the service for you.
You must have the rights and lawful basis needed to provide content and personal data. Do not place passwords, payment-card details, private keys, or other secrets in ordinary chat messages; use the dedicated secret controls.
Colver does not use customer content to train a Colver-owned foundation model. Third-party model and tool providers process the data sent to them under the configurations and terms described in the Privacy Policy and Subprocessor List.
6. Agents, tools, and sharing
You are responsible for the agent you design, the tools and data you authorise, the people you invite, and the uses you promote. Publishing an agent does not make its files, secrets, connected accounts, or creator conversation public. Visitor sessions are separated by account where the product states this.
Colver may require explicit approval before a sensitive or external action. You must not bypass these controls. The Shared Agents Policy, Connectors and Browser Policy, and Acceptable Use Policy are part of these Terms.
7. Subscriptions, credits, and payment
Paid subscriptions renew monthly until cancelled. A payment processor handles the charge. The plan, price, included credits, billing interval, and any applicable tax are shown before you place the order. You authorise recurring subscription charges to your selected payment method. Optional credit top-ups are separate one-time purchases and never renew automatically.
Credits measure service usage; they are not money, stored value, or a promise of a fixed number of tasks. Model tokens, requests, and tool calls can use different amounts. The Credits and Subscription Terms explain grants, reservations, expiry, referrals, and plan changes.
You can cancel through the billing controls. Cancellation stops the next renewal and does not normally refund a period already started, subject to mandatory consumer rights and the withdrawal terms below.
8. Consumer withdrawal and service problems
If you are an EU or EEA consumer, you normally have 14 days from entering a distance contract to withdraw. If you expressly ask Colver to start the paid service during that period and then withdraw, you may owe a proportionate amount for the service supplied before withdrawal. If the service has been fully performed after your prior express request and acknowledgement, the right may end where the law permits.
To withdraw, email help@colver.im with your name, account email, order date, and a clear statement that you withdraw. You may use your own wording. We will apply the refund method and timing required by law.
If a digital service is not supplied or does not conform to the contract, consumers have the remedies required by applicable law. Contact us first so we can investigate and, where appropriate, restore conformity, reduce the price, or end the contract.
9. Availability and changes
Colver depends on model, cloud, identity, payment, connector, and browser providers. We do not promise uninterrupted service. We may suspend a feature to address abuse, security, legal requirements, provider failure, or maintenance.
For material changes to these Terms, we will provide reasonable notice through the service or by email where required. Changes apply prospectively. If you do not accept a material change, you may stop using the service and cancel before the change takes effect.
10. Suspension and termination
You may stop using Colver at any time. We may restrict or terminate access for a serious or repeated breach, unlawful content, fraud, non-payment, a security threat, or a legal requirement. Where appropriate, we will explain the reason and offer a way to contest the decision.
On termination, access to the product can end. Certain provisions survive where their nature requires it, including payment obligations, rights ownership, confidentiality, limitations, and dispute terms. Data handling after termination is described in the Privacy Policy and any applicable Data Processing Addendum.
11. Warranties and liability
Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded, including mandatory consumer guarantees. Subject to those rights, Colver is provided with reasonable care and skill and without a promise that every output, integration, or agent will meet your purpose.
To the extent permitted by law, Colver is not responsible for indirect or unforeseeable loss, lost profit, or damage caused by content, instructions, approvals, tools, accounts, or data supplied or controlled by you. Any contractual liability cap that applies to a business customer will be set out in its order or written agreement. No cap applies where the law prohibits it, including for fraud, wilful misconduct, death, or personal injury caused by negligence.
12. Governing law and contact
Spanish law governs these Terms. Courts in Barcelona, Spain have jurisdiction for business disputes unless a written agreement says otherwise. Consumers may use the courts and mandatory protections available under the law of their habitual residence.
